ANP consolidates resolutions
ANP consolidates resolutions – The National Agency for Petroleum, Natural Gas and Biofuels – ANP published in the Official Gazette of the Union, on October 9, 2023, a set of 30 resolutions that consolidate and simplify around 111 existing resolutions. The regulations governing authorizations for the exercise of activities by economic agents in the lubricants segment and other segments of the petroleum derivatives market are of great interest.
The simplification of these resolutions aims to comply with Decree No. 10,139/2019, which provides for the review and consolidation of normative acts issued by public administration bodies.
The intention is not to change any rules already established in the resolutions already published, however, it is advisable that market entities carry out a thorough analysis to check if there were any typographical errors or anything similar that could bring any understanding different from what is already known. To this end, the Agency established a time interval (temporal lapse) between the publication of the law and it is coming into effect, called “vacatio legis”, of six months. During this period, the market will be able to comment if it identifies any changes in the published text.
Some of the resolutions of October 5, published in the Official Gazette of the Union, edition 193, of October 9, 2023, are:
ANP Resolution No. 941: Regulates the authorization to carry out the activity of producing finished lubricating oil.
ANP Resolution No. 942: Regulates the authorization to carry out the activity of re-refining used or contaminated lubricating oil.
ANP Resolution No. 943: Regulates the authorization to carry out the activity of collecting used or contaminated lubricating oil.
ANP Resolution No. 959: Regulates the authorization to carry out foreign trade activities in biofuels, oil and its derivatives and natural gas derivatives.
ANP Resolution No. 960: Regulates the authorization to operate storage facilities for automotive liquid fuels, aviation fuels, solvents, basic and finished lubricating oils, liquefied petroleum gas, fuel oil, lighting kerosene and asphalt, and the approval of provision of space or road loading.
