Unregistered lubricants
Unregistered lubricants – Between November 14th and 24th, the ANP carried out inspection actions in the fuel market in 18 units of the Federation, in all regions of the country.
In the actions, the inspectors verified the quality of the fuels, the supply of the correct volume by the metering pumps, adequacy of the equipment and instruments necessary for the correct handling of the products, documentation of the company’s grant and related to the movement of fuels.
In addition to routine inspections, the Agency also works in partnership with various public bodies. During this period, there were joint operations with the Public Ministry of Paraná (MP-PR), Procon-RJ and the Federal Police, among others.
See below the results of the main actions in the segments of gas stations and liquid fuel distributors; LPG resellers and distributors; between others:
Rio Grande do Sul
There were inspection actions in 31 gas stations, nine LPG retailers and one filling point in the municipalities of Portão, Capela de Santana, Viamão, Minas do Leão, Pantano Grande, Cachoeira do Sul, Charqueadas, Parobé, Triunfo, Canela, Gramado and San Francisco de Paula.
Two state posts, one in Cachoeira do Sul and another in Charqueadas, were fined for not having a standard measure measured and sealed by the National Institute of Metrology, Quality and Technology (Inmetro). The equipment is used to carry out the test that measures the volume of fuel delivered to consumers.
In the cities of Capela de Santana and Parobé, three service stations were fined for not displaying the price of all fuels sold on the price panel. In Minas do Leão, an LPG dealer was fined for not displaying the prices of cylinders, in addition to not having a decimal scale for weighing containers, which can be requested by consumers.
In Viamão, a gas station was fined because it did not have the equipment to carry out the fuel quality test, a procedure that can be requested by consumers.
Santa Catarina
In the period from 11/14 to 24/11, the ANP inspected two gas stations and eight LPG resellers in the cities of Benedito Novo, Papanduva, Porto Belo, Itapema and Tijucas.
Two LPG dealerships were banned, in Tijucas and Itapema, for having security problems in their installations.
In Benedito Novo, a fuel station was fined for not having the equipment for fuel analysis, which can be requested by consumers, in addition to not displaying the sticker with CNPJ on the pumps, not displaying a notice board, price panel of fuels sold and not informing fuel prices in accordance with Decree No. 11,121/2022, which made it mandatory to display liquid fuel prices on 06/22/2022. In the same city, an LPG dealer was fined for not displaying the prices of containers, in addition to not having a decimal scale for weighing cylinders, which can be requested by consumers.
Another LPG resale, this one in Porto Belo, was fined for administrative irregularities.
Paraná
In the state, the ANP visited 29 fuel stations, four LPG resellers and three distributors, two aviation fuel resellers and one supply point. The inspection actions took place in the cities of Araucária, Colombo, Curitiba, Floresta, Foz do Iguaçu, Iguaraçu, Itambé, Maringá and Ourizona.
The ANP participated in a task force with the Public Ministry of Paraná (MP-PR) and the Finance Department of the State of Paraná (Sefa-PR), from 11/22 to 24, in the municipalities of Floresta, Iguaraçu, Itambé, Maringá and Ourizona. In these actions, nine gas stations were inspected and no irregularities were found.
In Maringá, the Agency also worked together with Procon Municipal to verify the operation of a supply point. No violations were found on site.
Distrito Federal
In the Federal District, inspection actions were carried out at 12 gas stations in Águas Claras, Asa Sul, Ceilândia, Recanto das Emas, Samambaia, SIA, SIG and Taguatinga, including a joint operation with Procon-DF.
A CIS station was fined and had a fuel supply nozzle banned for irregularity in the amount dispensed to the consumer.
Mato Grosso
Inspection actions were concentrated in the cities of Cuiabá and Sorriso, where inspectors inspected four LPG dealerships and two gas stations.
In Cuiabá and Sorriso, the inspections were carried out in partnership with the municipal Procons within the scope of the technical cooperation agreements signed with the ANP. No irregularities were found.
Goias
In all, inspectors checked the operation of 27 gas stations, six fuel distributors and three LPG resellers in the cities of Quirinópolis, Cachoeira Alta, Campos Belos, Goiânia, Anápolis and Senador Canedo.
In Quirinópolis, six service stations were fined for infractions such as the lack of equipment to carry out fuel quality tests, which can be requested by consumers, and irregular measurement of the metering pump, which led to the banning of an ethanol spout, among other irregularities. . In the same city, three LPG resellers were fined: one for not displaying the price of full containers in the establishment, another for not having identification of the LPG reseller and the brand sold and the third for not having fire extinguishers within the expiry date (in this case, a precautionary interdiction measure was applied to replace fire extinguishers).
A fuel station in Cachoeira Alta was also fined for not having the equipment used in the quality tests.
Mato Grosso do Sul
In Mato Grosso do Sul, inspectors were at ten fuel stations and two ethanol producers in the municipalities of Batayporã and Nova Andradina, where one station was fined for not having the equipment to analyze the quality of fuels, a procedure that can be requested by the consumers.
Tocantins
There were inspection actions at six gas stations in the cities of Arraias, Combinado and Novo Alegre.
One of the establishments, located in Combinado, was fined for irregularly measuring the regular gasoline metering pump. The problem was corrected during inspection.
Minas Gerais
ANP agents were present in the municipalities of Betim, Contagem, Belo Horizonte, Alfenas, Divisa Nova, Fama, Lavras, Paraguaçu, Serrania, Varginha, Bela Vista de Minas, Nova Era, Ponte Nova, Rio Casca and Esmeraldas. In all, 62 field inspections were carried out at gas stations, LPG resellers, fuel distributors and transporters-resellers-retailers (TRRs).
In Varginha, the ANP participated in a task force with the Federal Police, the Minas Gerais State Treasury Department, the Metrology and Quality Institute and the State Procon. A station that was acting as a TRR in the region was the target of assessments by the ANP.
A fuel distributor in Betim was fined for irregularities in the supply of test samples to retail stations. Also in Betim, lubricating oils sold illegally registered with the ANP were seized.
In the city of Alfenas, fuel stations were fined for filling containers without the seal of the National Institute of Metrology, Quality and Technology (Inmetro), irregularities in the price panel and for displaying a trademark being registered with the ANP as a white flag.
In Lavras and Varginha, two white flag posts were also fined for displaying visual manifestations of commercial brands.
In the municipality of Ponte Nova, an LPG dealership was banned for not having a fixed fire system.
In the capital, lubricating oils with irregular registration with the ANP were apprehended.
Espírito Santo
ANP inspectors were in the municipalities of Guarapari and Vila Velha during the period. Eight gas stations and four LPG resellers were inspected.
In both cities, joint actions were carried out with the state Civil Police. Three LPG dealerships were fined and banned for supplying full LPG containers to other dealerships that did not have ANP authorization to operate.
Rio de Janeiro
Thirty-three gas stations were inspected by ANP inspectors in the cities of Santo Antônio de Pádua, Aperibé, Campos dos Goytacazes, Itaboraí, São Gonçalo and Rio de Janeiro.
In Santo Antônio de Pádua and Aperibé, there were joint actions with Procon-RJ, the State Department of Finance in Rio de Janeiro (Sefaz-RJ) and Operation Focus, coordinated by the State Department of the Civil House. One service station was fined for selling out-of-spec fuels and had nozzles and equipment banned (common hydrated ethanol with an alcohol content of 87.8%, when the correct is 92.5 to 95.4%, and B S10 diesel oil with a dirty appearance and cloudy, diverging from the clear appearance and free of impurities).
In the capital of Rio de Janeiro, there was a joint operation with the Special Police Station for Crimes against Consumers (Decon-RJ) and Procon, and a service station was fined and had equipment banned for selling regular gasoline with an alcohol content outside the specification.
In the other municipalities surveyed, no irregularities were recorded.
Sao Paulo
In the last two weeks, the ANP visited 11 municipalities in the state of São Paulo: Barueri, Bertioga, Diadema, Osasco, Peruíbe, Piedade, Praia Grande, Santos, São Lourenço da Serra, São Paulo and Taboão da Serra. In all, 48 gas stations, 11 LPG resellers and two supply points were inspected.
In Osasco, a gas station was fined and completely banned (18 nozzles and four tanks) for: selling unspecified gasoline with 55% anhydrous ethanol (as determined by law is 27%); to commercialize common and additive hydrated ethanol out of specification in terms of methanol content (above 0.5%); not presenting the Chemical Product Safety Data Sheet (FISPQ); not presenting the simplified plant of the facilities; and outdated registration of equipment.
On the coast, in Santos, a service station had 50 liters of finished lubricating oil seized for lack of registration of the product with the ANP. In Praia Grande, a fuel retailer was fined for not displaying fuel prices correctly and not having a thermodensimeter (equipment attached to ethanol pumps to check quality aspects).
In the capital, a gas station was fined for: having a thermodensimeter without properly operating a hydrous ethanol pump; have a standard measure of 20 liters with a leak (the equipment is used to test the volume of fuels); not having all the equipment for quality tests, which can be requested by consumers; have an underground tank not connected to the supply pumps; and not reporting an incident to the ANP. Another service station in São Paulo was fined for not having all the equipment for quality tests, keeping a thermodensimeter without operating properly in a hydrous ethanol pump and not displaying fuel prices correctly.
Still in São Paulo, a service station had 56 liters of finished lubricating oil seized for lack of registration of the product with the ANP, and two more fuel stations were fined for not having all the equipment for quality tests.
Paraíba
The inspectors were in the municipality of Caiçara, where a fuel station was fined for not having a thermodensimeter (equipment attached to ethanol pumps to check quality aspects) nor the necessary equipment to carry out fuel quality tests, a procedure that consumers can sue.
Rio Grande do Norte
A fuel station in the city of Parnamirim was fined because, at the time of the inspection, no representative knew how to carry out the fuel quality tests, which may be required by consumers.
Bahia
The cities of Sapeaçu, Salvador and Tucano had economic agents inspected by Agency inspectors in the period. The operation of 24 establishments was verified, including gas stations and LPG resellers.
In the capital, a service station was fined for selling hydrated ethanol outside the specifications provided for in the legislation. At the site, four supply spouts and a tank of the product were banned. An LPG retailer in the capital was also fined and banned for withholding products, for lack of security at the facilities and for having installations and equipment that did not comply with the regulations. Another similar establishment was fined for not requesting authorization cancellation within 30 days after the installation was deactivated.
A service station in Sapeaçu was fined for selling diesel oil B S500 and regular gasoline outside the specifications established by current legislation.
Alagoas
In the state, there were inspections at seven gas stations, one in São Miguel dos Campos and six in Maceió.
All establishments were fined. The inspectors found irregularities such as the standard measure of 20L (equipment used for the volume test) in disagreement with the legislation and supply in non-certified containers, among other problems.
Maranhão
There was inspection in the cities of São Luís, Paço do Lumiar and Bacabeira. The inspectors visited 19 economic agents, including gas stations and LPG resellers.
In the case of the assessed fuel stations, the most common problems were due to incorrect procedures when filling up and the absence of safety devices to operate the metering pumps.
A LPG dealer in Bacabeira was also fined for presenting a number of fire extinguishers that did not comply with the legislation and for not presenting a decimal scale for weighing cylinders, which can be requested by consumers.
Piauí
Inspection actions took place in the cities of Teresina, Altos, Campo Maior, Demerval Lobão, José de Freitas and União. In all, 44 gas stations were visited, and none showed irregularities.

The ANP’s inspection actions are planned based on several intelligence vectors, such as consumer complaints, data from the Agency’s Fuel Quality Monitoring Program (PMQC), information from other bodies and the ANP’s Intelligence area, among others. . In this way, actions are focused on regions and economic agents with signs of irregularities.
To follow all ANP inspection actions, access the Supply Inspection Dynamic Panel. The database is updated monthly, with a period of two months between the month of inspection and the month of publication, due to compliance with legal requirements and operational aspects.
Establishments fined by the ANP are subject to fines that can range from R$5,000 to R$5 million. Sanctions are applied only after an administrative process, during which the economic agent has the right to full defense and contradictory, as defined by law.
