Regulation of gas stations in Brazil
Brazilian Petroleum, gas and biofuels Agency – ANP, held on Wednesday (01/22), in Rio de Janeiro, a workshop to discuss, with market representatives, the revision of ANP Resolution No. 41/2013, related to the retail fuel resale activity.
ANP’s Superintendent of Distribution and Logistics, Cézar Issa, represented director Felipe Kury at the opening of the event. “The objective is to provide the debate, to listen to you. This is an important moment, when we were able to put into practice our promise to review, in a conscious and responsible way, a large part of the regulatory framework of the supply segment ”, he said.
Among the main points debated on the resolution, was the regulatory protection of loyalty to the flag, that is, the inspection by the ANP, if the flagged stations are selling only fuel from the distributors to which they are linked.
Other points discussed were the regulation of the sale of fuels outside the establishment of service stations; the possible removal of the third digit of the fuel price at the service stations; the summary suspension of the authorization to operate the post that violates ANP’s inspection seal, until its situation is regularized; and changes in the documents required in the authorization granting process, in order to prove the identity and suitability of the partners.
This was the third workshop of the four that the ANP prepared to discuss norms that deal with fuel supply activities. Yesterday, the revisions of ANP Resolutions No. 67/2011, which deals with the acquisition / storage of anhydrous ethanol, and No. 43/2009, on the sale of hydrated ethanol, were discussed. The workshops are a first step in the process of reviewing the resolutions, with the aim of providing transparency to the actions provided for in the ANP Regulatory Agenda, and will serve as a subsidy for the improvement of the rules. In the future, as required by law, the topics will undergo analysis of regulatory impact (AIR) and the possible minutes for changing resolutions will be submitted to the public consultation and hearing process before their publication.
